SKYHELICOPTERTOUR – RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

BY CONTINUING WITH THIS BOOKING, YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS. PLEASE READ CAREFULLY AS YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

This agreement is entered into between the participant (“Participant”) and SkyHelicopterTour, operated by SkySafe Aviation LLC (“Operator”), regarding participation in any helicopter tour or related activities.

1. DEFINITION OF ACTIVITIES

"Tour Activities" refer to all experiences offered or arranged by the Operator, including but not limited to:

Helicopter sightseeing flights

Ground transport to/from aircraft (golf cart or shuttle)

Embarking and disembarking from aircraft

Safety briefings and instructions

Movements around helicopters, landing pads, and facilities

Overwater or coastal flights, and any other optional activities

2. ASSUMPTION OF RISKS

I acknowledge that helicopter tours carry inherent risks, including but not limited to:

Equipment malfunction or mechanical failure

Sudden weather changes or turbulence

Takeoff, flight, or landing accidents

Personal injury from falls, slips, or collisions

Altitude-related effects or confined space discomfort

I understand these risks may result in injury, illness, disability, or death, and I voluntarily assume full responsibility for all consequences.

3. RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release and hold harmless the Operator, its employees, contractors, pilots, affiliates, and agents from any and all claims for:

Injury, loss, death, or property damage

Any cause whatsoever, including negligence

Any claim by my estate, family, or representatives

4. INDEMNITY AGREEMENT

I agree to indemnify and defend the Operator from any and all liability or expenses arising from my participation, including:

Claims made by third parties due to my conduct

Legal fees, court costs, or settlements

5. HEALTH & MEDICAL DECLARATION

I confirm that I am physically and mentally fit to participate in the helicopter tour. I do not suffer from any medical condition that would be aggravated by this activity and understand that I participate at my own risk.

6. PHOTOGRAPHY & MEDIA RELEASE

Unless otherwise requested in writing, I authorize the Operator to use photographs, videos, or recordings of me during the activity for promotional and commercial purposes.

7. GOVERNING LAW & JURISDICTION

This agreement shall be governed by the laws of the State of Florida. Any legal dispute shall be resolved exclusively in the courts of Broward County, Florida.

8. ELECTRONIC ACCEPTANCE

By checking the box or clicking “I Agree” at the time of booking, I confirm that I have read, understood, and voluntarily accepted the terms of this waiver and release. I understand that this has the same legal effect as signing a physical document.
